1.2 The Website is operated by My VCard, having its registered office at Supreme Flat #59, Sathy Main Road, Ganapathy, Coimbatore 641006 (“My VCard”, “we”, “us”, or “our”).
1.3 By accessing or using the Website or Services, the user (“My VCard”, “your”, “User”, “Customer”) agrees to be bound by these Terms, our Privacy Policy, and any additional policies displayed on the Website.
2.1 You must be at least 18 years old and capable of forming a legally binding contract under the Indian Contract Act, 1872, to use the Services.
2.2 You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

5.1 After receiving your payment and required content (text, images, logo, contact details, etc.), the Company will create and activate your Digital Visiting Card, Mini Website, or WhatsApp Store within an indicative time frame of 10 to 20 business days, subject to complexity and content submission.
5.2 The Service will be treated as delivered once the digital product is designed, uploaded, and a live link or preview is shared with you.
5.3 Basic technical support for activation and minor edits is provided via WhatsApp/Email/Phone during standard business hours of IST, unless otherwise specified in a separate Service Level Agreement.
6.1 You are solely responsible for all content (text, images, logos, links, product descriptions, prices, etc.) that you provide to be used in your Digital Visiting Card, Mini Website, or WhatsApp Store (“User Content”).

7.1 All rights, title, and interest in and to the Website, its design, layout, logos, graphics, software, and underlying code remain the exclusive property of the Company or its licensors.
7.2 Subject to full payment of applicable fees, you receive a limited, non-exclusive, non-transferable license to use the specific digital card/mini website/WhatsApp store created for you for your business promotion, during the active subscription or service period.
7.3 You may not copy, reproduce, distribute, modify, or create derivative works of the Website or its content except for your own lawful business promotion as intended by the Service.
8.1 The Services may rely on third-party hosting providers, domain registrars, messaging platforms (such as WhatsApp), and payment gateways.
8.2 While reasonable efforts will be made to keep your digital card/mini site/WhatsApp store accessible, the Company does not guarantee uninterrupted or error-free availability and is not liable for downtime caused by third-party failures, maintenance, or circumstances beyond its control.
8.3 Any separate Service Level Agreement (SLA) or hosting terms, if provided, will be read together with these Terms; in case of conflict, the specific signed agreement will apply for the covered services.
9.1 The WhatsApp Store feature uses WhatsApp as a communication and ordering channel, but the Company is not affiliated with or endorsed by WhatsApp Inc. or Meta Platforms.
9.2 All orders, chats, and transactions conducted via WhatsApp are between you and your customers; you are responsible for compliance with WhatsApp terms and any applicable e-commerce or consumer protection laws.
9.3 The Company is not responsible for message delivery failures, account blocks, or penalties imposed by WhatsApp or other platforms due to your use.
10.1 By using the Website or Services, you may provide personal data such as names, contact details, and business information. Such data will be processed in accordance with our Privacy Policy and applicable Indian data protection laws, including the Information Technology Act, 2000, the SPDI Rules 2011, and the Digital Personal Data Protection Act 2023, as amended from time to time.
10.2 You must obtain necessary consent from your customers or visitors before collecting, storing, or using their personal data through your digital card, mini website, or WhatsApp store.
10.3 You agree not to misuse or sell personal data collected via the Services in violation of any applicable data protection or privacy law.
11.1 Due to the nature of digital and customized services, fees paid for Digital Visiting Cards, Mini Websites, and WhatsApp Store setups are generally non-refundable once initial design work has started or a preview link has been shared.
11.2 At the Company’s sole discretion, a limited refund or partial credit may be considered in exceptional circumstances, subject to deduction for work already performed and third-party costs.
11.3 For subscription-based plans, non-payment or delayed payment may result in suspension or termination of hosting and related services after a reasonable notice period.
12.1 To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, consequential, or special damages (including loss of profits, data, or business opportunities) arising out of or in connection with the use or inability to use the Website or Services.
12.2 The total aggregate liability of the Company for any claim arising from these Terms or the Services shall not exceed the total amount paid by you to the Company for the specific Service giving rise to the claim in the last [3/6/12] months.
